TERMS OF USE
1. Purpose and Scope
These Terms of Use regulate your technical interaction with the StaysCo website, applications, and MyStaysCo dashboard (collectively referred to as the Platform). While they establish the rules for digital access, they specifically exclude the governance of accommodation bookings or payment processing, which are managed under separate agreements like StaysCo Guest Terms and Conditions and the StaysCo Payment Terms of Service.By creating an account, uploading information or documents, or using any authenticated or interactive feature of the Platform, you agree to be bound by these Terms of Use.
2. Eligibility and Account Governance
Access to restricted areas of the Platform and account creation are limited to individuals who are at least eighteen years of age and who have the legal capacity to enter into binding agreements.You are responsible for ensuring that all information provided to StaysCo through the Platform is accurate, complete, and kept up to date. You are solely responsible for all activity conducted through your account and for maintaining the confidentiality of your login credentials.
3. Document Uploads and Information Sharing
The Platform may allow users to upload documents and information, including identity documents, proof of income, or other materials requested in connection with a booking process.StaysCo acts solely as a technical intermediary providing a digital interface for the transmission of such documents. StaysCo does not authenticate, or assess the legal sufficiency of any uploaded document and does not perform identity verification, financial verification, or regulatory compliance checks on behalf of Property Managers referring to the legal entity or individual providing the accommodation and entering into the rental contract with the Guest.By uploading documents to the Platform, you expressly authorise StaysCo to transmit and share such documents with the relevant Property Manager or designated third party for the purpose of facilitating or verifying a booking. Responsibility for reviewing, assessing, and accepting any documentation rests exclusively with the receiving party.
4. Electronic Actions and Digital Records
You acknowledge that actions performed through the Platform, including clicking buttons labelled “Accept”, “Confirm”, “Book”, or similar, constitute your electronic consent and evidence your intent to be legally bound where applicable.You agree that StaysCo’s digital records, including system logs, timestamps, and account activity records, may be used as evidence of your actions and instructions on the Platform, subject to applicable law.Nothing in this clause limits your statutory rights or prevents you from challenging the substance of a transaction in accordance with applicable contractual terms and consumer protection laws.
5. Licence and Acceptable Use
Subject to compliance with these Terms of Use, StaysCo grants you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Platform solely for its intended purpose.You must not misuse the Platform or attempt to interfere with its operation. This includes attempting to gain unauthorised access, scraping or harvesting data, reverse engineering functionality, introducing malicious code, or using the Platform in a manner that could damage, disable, or impair its security or availability.
6. Intellectual Property
All intellectual property rights in the Platform, including software, workflows, designs, content, text, graphics, and underlying technology, are owned by or licensed to StaysCo.Nothing in these Terms of Use grants you any ownership rights in the Platform or its intellectual property. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Platform without prior written consent from StaysCo.
7. Platform Availability and Modifications
StaysCo does not guarantee uninterrupted or error-free operation of the Platform. Access may be temporarily suspended for maintenance, updates, security reasons, or technical issues.StaysCo may modify, update, or discontinue features of the Platform from time to time, provided that such changes do not affect confirmed bookings governed by separate contractual terms. Updated versions apply to future bookings and, where legally required, may require renewed acceptance.
8. Suspension and Termination
StaysCo may suspend or terminate access to the Platform where it reasonably determines that a user has breached these Terms of Use, misused the Platform, or created legal, security, or operational risk.Termination of Platform access does not automatically affect confirmed bookings, which remain governed by the applicable Guest Terms and Conditions and Payment Terms of Service unless suspension or termination is required to prevent harm or comply with legal obligations.
9. Limitation of Liability
StaysCo provides the Platform on an "as-is" and "as-available" basis. To the maximum extent permitted by the laws of the Grand Duchy of Luxembourg, StaysCo shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, loss of data, or business interruption, arising from your technical use of the Platform..To the maximum extent permitted by the laws of the Grand Duchy of Luxembourg, StaysCo shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, loss of data, or business interruption, arising from your technical use of or inability to access the Platform.StaysCo does not warrant that the Platform will meet specific requirements, operate without interruption, or be free from errors. Nothing in these Terms of Use limits liability that cannot be excluded under applicable law.
10. Third-Party Services
The Platform may integrate or link to third-party services. StaysCo does not control and is not responsible for the content, availability, or practices of such third parties. Use of third-party services is subject to their own terms and policies.
11. Governing Law and Jurisdiction
These Terms of Use and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Grand Duchy of Luxembourg. Subject to mandatory consumer protection provisions, the courts of Luxembourg City shall have exclusive jurisdiction.
12. Data Protection and Privacy
StaysCo is committed to protecting your privacy and ensuring the security of your personal data. All data collected, processed, and shared through the Platform will be handled in strict compliance with the General Data Protection Regulation (GDPR), applicable national regulations of the Grand Duchy of Luxembourg, and StaysCo’s Privacy Policy.By using the Platform, you acknowledge that you have read and understood how your data is processed as described in the Privacy Policy (link).
13. Entire Agreement and Order of Precedence
This Agreement (comprising all documents listed below) constitutes the entire agreement between the Guest and StaysCo and supersedes all prior understandings or representations. In the event of any irreconcilable conflict or inconsistency between the documents forming this Agreement, the following descending order of precedence shall apply:
a.The Booking Confirmation (including the specific price, dates, cancellation policy, and house rules).
b.These Guest Terms and Conditions.
c.The Payment Terms of Service.
d.The Privacy Policy and any other incorporated policies.
